This Refund Policy (“Policy”) governs all purchases made through KultivateHer (“KultivateHer,” “we,” “us,” or “our”), including but not limited to coaching services, subscription programs, digital products, guides, and educational materials (collectively, the “Services”).

By purchasing or accessing the Services, you acknowledge that you have read, understood, and agree to this Refund Policy.


1. Legal Basis and Consumer Law Compliance

This Refund Policy is designed in accordance with:

  • Federal Trade Commission (FTC) Act (15 U.S.C. §§ 41–58), which governs unfair or deceptive acts in commerce

  • FTC Digital Goods and Online Commerce Guidelines

  • Texas Deceptive Trade Practices–Consumer Protection Act (DTPA)

  • Uniform Commercial Code (UCC), where applicable to digital transactions

Under U.S. law, businesses may lawfully enforce a “no-refund” or limited refund policy for digital products and personalized services provided the policy is clearly disclosed prior to purchase.


2. All Sales Are Final

Due to the digital, subscription-based, and personalized nature of KultivateHer’s Services:

ALL SALES ARE FINAL.

This includes, but is not limited to:

  • 1:1 coaching services

  • Subscription programs and memberships

  • Digital downloads, guides, and educational materials

  • Online challenges or self-paced programs

Once access to the Services is granted, no refunds, returns, exchanges, or credits will be issued.

This policy complies with FTC guidance on digital content and consumer disclosures.


3. No Refunds for Non-Use or Early Termination

Refunds will not be issued for:

  • Failure to use the Services

  • Scheduling conflicts or personal circumstances

  • Dissatisfaction with results

  • Early termination of coaching or subscriptions

  • Failure to cancel a subscription before renewal

You acknowledge that results may vary and depend on individual effort, consistency, and circumstances.


4. Subscription Billing and Cancellation

Subscriptions

  • Subscription fees are billed automatically on a recurring basis as disclosed at checkout.

  • You are responsible for canceling your subscription prior to the renewal date.

  • Once a subscription payment has been processed, no refunds will be issued for that billing cycle.

Cancellation prevents future charges only and does not entitle you to a refund for past or current charges.


5. Chargebacks and Payment Disputes

Initiating a chargeback or payment dispute for services already rendered or accessed constitutes a material breach of KultivateHer’s Terms and Conditions.

KultivateHer reserves the right to:

  • Provide documentation to the payment processor disputing the chargeback

  • Suspend or permanently terminate access to the Services

  • Recover any fees, costs, or losses incurred as a result of the chargeback

This policy aligns with standard protections under Stripe, PayPal, and U.S. merchant regulations.


6. Exceptions Required by Law

Refunds will be issued only if required by applicable law.

If a mandatory statutory right applies based on your jurisdiction, KultivateHer will comply strictly with such legal requirements and no more.


7. Consumer Acknowledgment

By completing a purchase, you expressly acknowledge and agree that:

  • You are purchasing digital or personalized services

  • You waive any statutory “cooling-off” period to the extent permitted by law

  • You understand and accept the no-refund policy

This acknowledgment satisfies disclosure requirements under FTC and Texas consumer protection law.


8. Changes to This Refund Policy

KultivateHer reserves the right to modify this Refund Policy at any time. Any changes will be posted with an updated “Last Updated” date. Changes apply prospectively only.
